VDH Withdraws Electronic Monitoring Regulation; New Effective Date TBD

Amid questions by the Virginia Health Care Association (VHCA) and others regarding some of the regulatory language for electronic monitoring of nursing facility residents, the Virginia Department of Health (VDH) has withdrawn the regulation citing the need to be “more consistent with the provisions of the 2007 guideline.”  VHCA reported on July 16 that the electronic monitoring guidelines in effect since 2007 were being codified into regulations to take effect on August 29 (see article).

VDH plans to initiate a new “fast track” action once corrections can be made; the effective date of the regulations will depend upon the date of publication of the new language, the required public comment period, and other administrative requirements.  VHCA will alert you when VDH restarts that process with corrected regulatory language.
